2. Collection and storage of personal data as well as type and purpose of their use

a) Scope of the processing of personal data

As a matter of principle, we only process personal data of our users insofar as this is necessary for the provision of a functional website as well as our contents and services. The processing of personal data of our users is regularly only carried out after the consent of the user. An exception applies in those cases in which obtaining prior consent is not possible for actual reasons and the processing of the data is permitted by legal regulations.

Insofar as we obtain the consent of the data subject for processing operations involving personal data, point (a) of Art. 6 (1) GDPR serves as the legal basis.

When processing personal data that is necessary for the performance of a contract to which the data subject is a party, point (b) of Art. 6 (1) GDPR serves as the legal basis. This also applies to processing operations that are necessary for the performance of pre-contractual measures.

Insofar as the processing of personal data is necessary for the fulfilment of a legal obligation to which our company is subject, point (c) of Art. 6 (1) GDPR serves as the legal basis.

If the processing is necessary to protect a legitimate interest of our company or a third party and the interests, fundamental rights and freedoms of the data subject do not outweigh the former interest, point (f) of Art. 6 (1) GDPR serves as the legal basis for the processing.

b) Data deletion and storage period

The personal data of the data subject shall be deleted or blocked as soon as the purpose of the storage no longer applies. Storage may also take place if this has been provided for by the European or national legislator in Union regulations, laws, or other provisions to which the person responsible is subject. The data will also be blocked or deleted if a storage period prescribed by the aforementioned standards expires, unless there is a necessity for the continued storage of the data for the conclusion or fulfilment of a contract.

c) When visiting the website

When you visit our website www.umtec-halle.de, the browser used on your end device automatically sends information to the server of our website. This information is NOT stored.

d) Request by e-mail, telephone, or fax

If you contact us by e-mail, telephone or fax, your request, including all resulting personal data (name, request) will be stored and processed by us for the purpose of processing your request. We do not pass these data on without your consent.

These data are processed based on point (b) of Art. 6 (1) GDPR if your inquiry is related to the fulfilment of a contract or is required for the performance of pre-contractual measures. In all other cases, the data are processed based on our legitimate interest in the effective handling of inquiries submitted to us (point (f) of Art. 6 (1) GDPR) or based on your consent (point (a) of Art. 6 (1) GDPR) if it has been obtained.

The data sent by you to us via contact requests remain with us until you request us to delete, revoke your consent to the storage or the purpose for the data storage lapses (e.g., after completion of your request). Mandatory statutory provisions - in particular statutory retention periods - remain unaffected.

e) When using our e-mail addresses

If you send us e-mails, your e-mail address will only be used for correspondence with you. Information that you send to us unencrypted by e-mail can possibly be read by third parties on the transmission path. As a rule, we are also unable to verify your identity and do not know who is hiding behind an e-mail address, so that legally secure communication by simple e-mail is therefore not guaranteed.

If we are approached by e-mail, we assume that you agree to unencrypted communication by this means and that this can take place in this way, insofar as this does not conflict with statutory regulations.

3. Data transmission

Your personal data will not be transferred to third parties for purposes other than those listed below.

We share your personal data with our affiliates, other trusted companies or persons who process it on our behalf. This is done based on our instructions and in accordance with our privacy policy and other appropriate confidentiality and security measures.

We will only share your personal information with third parties if:

a) you have given your express consent in accordance with point (a) of Art. 6 (1) GDPR,
 

b) this is legally permissible and necessary according to point (b) of Art. 6 (1) GDPR for the processing of contractual relationships with you,
 

c) in the event that there is a legal obligation for the disclosure pursuant to point (c) of Art. 6 (1) GDPR, as well as

d) the disclosure is necessary for the assertion, exercise, or defence of legal claims pursuant to point (f) of Art. 6 (1) GDPR and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data.

4. Cookies

a) We use cookies on our site. These are small files that are automatically created by your browser and stored on your end device (laptop, tablet, smartphone or similar) when you visit our site. Cookies do not cause any damage to your end device and do not contain any viruses, Trojans, or other malware.
 

b) The use of technically necessary cookies serves to make the use of our offer more pleasant for you. Some functions of our website cannot be offered without the use of cookies. For example, we use so-called session cookies to statistically record the user or to limit the misuse of the contact form. Another cookie stores the information that a user has agreed to the cookie storage. The user data collected through technically necessary cookies are not used to create user profiles.

d) The legal basis for the processing of personal data using technically necessary cookies is point (f) of Art. 6 (1) GDPR. The operator of the website has a legitimate interest in the storage of required cookies to ensure the technically error free and optimized provision of the operator’s services. If your consent to the storage of the cookies and similar recognition technologies has been requested, processing occurs exclusively based on the consent obtained (point (a) of Art. 6 (1) GDPR and § 25 (1) TTDSG); this consent may be revoked at any time.
 

e) Cookies are stored on the user's computer and transmitted from it to our site. Therefore, you as a user also have full control over the use of cookies. 5. Google Maps

This site uses the map service Google Maps via an API. The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

To the best of our knowledge, Google collects the following data in order to use the Google Maps functions:

a) IP address,

b) the (start, destination) addresses entered as part of route planning,

c) Date and time of the visit to the website in question,

d) Internet address or URL of the accessed website.

This information is usually transferred to a Google server in the USA and stored there. The provider of this site has no influence on this data transmission.

If you do not want Google to collect, process or use data about you via our website, you can deactivate JavaScript in your browser settings. In this case, however, you will not be able to use the map display.

Google Maps is used in the interest of an appealing presentation of our online offers and to make it easy to find the places we have indicated on the website. This represents a legitimate interest within the meaning of point (f) of Art. 6 (1) GDPR.

  1. to request information about your personal data processed by us in accordance with Art. 15 GDPR. In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of complaint, the origin of your data if it has not been collected by us, as well as the existence of automated decision-making, including profiling, and, if applicable, meaningful information about its details. You have the right to request information on whether the personal data concerning you is transferred to a third country or to an international organisation. In this context, you may request to be informed about the appropriate safeguards pursuant to Art. 46 GDPR in connection with the transfer;
  2. demand the correction of incorrect or incomplete personal data stored by us without delay in accordance with Art. 16 GDPR;
  3. pursuant to Art. 17 GDPR to request the erasure of your personal data stored by us, unless the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the assertion, exercise or defence of legal claims;
  4. to request the restriction of the processing of your personal data in accordance with Art. 18 GDPR, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you object to its erasure and we no longer require the data, but you need it for the assertion, exercise or defence of legal claims or you have objected to the processing in accordance with Art. 21 GDPR;
  5. pursuant to Art. 20 GDPR to receive your personal data that you have provided to us in a structured, common and machine-readable format or to request the transfer to another controller;
  6. revoke your consent at any time in accordance with Art. 7 (3) GDPR. This has the consequence that we may no longer continue the data processing based on this consent for the future, and
  7. complain to a supervisory authority in accordance with Art. 77 GDPR. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or our company headquarters.Right to objection

If your personal data is processed based on point (f) of Art. 6 (1) GDPR, you have the right to at any time object to the processing of your personal data pursuant to Art. 21 GDPR, insofar as there are grounds for doing so that arise from your particular situation or the objection is directed against direct advertising. In the latter case, you have a general right of objection, which is implemented by us without specifying a particular situation.

8. Data security

We use the popular SSL procedure (Secure Socket Layer) in connection with the highest encryption level supported by your browser when visiting the website. Normally, this is a 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. You can recognize whether an individual page of our website is transmitted in encrypted form by the appearance of the lock icon in the URL line of your browser.

We also use appropriate technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or against unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.

This privacy policy applies to all services offered by umtec Halle GmbH and its affiliated companies.

This privacy policy does not apply to the handling of data by other companies and organizations that advertise our services, as well as services that are displayed to you in search results.
